Cancellation & Refund Policy
1. What is a Deposit?
A deposit is an amount of money paid by one party to another at the time of concluding a contract, serving as evidence that the agreement has been made.
Under Article 177 of the Turkish Code of Obligations, this is defined as a “binding payment”.
Article 177 – Binding Payment
Unless otherwise agreed or required by local custom, any amount paid at the time of contract formation is deemed to be a binding payment rather than a withdrawal fee. Such payment is deducted from the total amount due.
Accordingly, unless otherwise stated in the agreement, the deposit paid will be deducted from the total balance payable by the customer.
If the purpose of the payment is not explicitly defined, it is presumed to be a deposit. The burden of proof lies with the party claiming otherwise.
2. Difference Between Deposit and Withdrawal Fee
A deposit is different from a withdrawal fee.
- A deposit is deducted from the total price of the service.
- A withdrawal fee allows either party to terminate the agreement:
- The paying party may withdraw and forfeit the amount paid.
- The receiving party may withdraw by returning double the amount received.
3. Cancellation Policy (Individual Bookings)
In accordance with the Regulation on the Relations of Tourism Enterprises with the Ministry, Each Other and Their Customers:
Individual booking agreements apply to reservations made for 1 to 10 guests.
Unless otherwise agreed, cancellations are permitted within the following periods:
- During high-demand periods:
Within the cancellation period applied by the hotel, which shall not be less than 24 hours. - Holiday resorts:
- High season: up to 30 days before arrival
- Low season: up to 14 days before arrival
Cancellations made after these periods may result in compensation charges.
4. Cancellation Charges
If a booking is cancelled outside the permitted periods, or in case of a no-show:
- The hotel reserves the right to charge:
- At least one night’s stay (including room and any applicable services)
- During high season: up to three nights’ stay
If a guest arrives late, leaves early, or does not use part or all of the booked services (and this is not due to the fault of the hotel), the hotel reserves the right to claim compensation for the actual loss incurred.
5. Payments and Outstanding Balances
If any advance payment does not cover the total invoice amount, the hotel reserves the right to request the remaining balance directly from the customer.
6. General Conditions
- The hotel’s standard policies apply equally to all customers.
- In case of late payment of compensation, relevant legal provisions shall apply.
